Terms of Use
These Terms of Use ("Terms") govern your use of the Thummer mobile app and the website thummerapp.com (together, "Thummer"). Thummer is provided by Michael Harlow, doing business as Thummer, 1770 E Valley Pkwy, Box 300184, Escondido, CA 92030, USA ("we," "us"). By installing or using Thummer, you agree to these Terms. If you do not agree, do not use Thummer.
1. What Thummer does
Thummer is an anti-theft app for Android. While protection is on, you keep one thumb in an on-screen Safe Zone. If that touch leaves the screen, Thummer blacks out the display, asks for your fingerprint, and, if you are not verified within a few seconds, locks your phone using Android's own device lock. An optional alarm can sound after the lock. Thummer requires Android 11 or later and a fingerprint enrolled on your phone.
2. What Thummer does not do
- Thummer cannot prevent theft. It is designed to protect what is on your phone at the moment it is taken, by locking it. It does not stop anyone from taking your phone.
- Thummer does not track, locate, or recover phones, and it does not contact the police or anyone else.
- Thummer does not replace other protections. Keep your phone's screen lock, Google's built-in theft protection, and your carrier, bank, and account security in place.
- No security tool is perfect. Locking depends on your phone, its Android version, its settings, and the conditions at the time.
3. Your safety comes first
Never put yourself at risk to protect a phone. If someone tries to take your phone, let it go, get to safety, and contact local authorities. Thummer is not designed for and must not be relied on in emergencies, for medical or life-safety purposes, or in any situation where a locked phone could put you or anyone else in danger (for example, while driving or while you may need to call for help). Use Practice mode to learn how Thummer behaves before you rely on it.
4. Subscriptions, free trial, and refunds
- Thummer is offered as a paid subscription through Google Play: currently $4.99 per month or $29.99 per year (U.S. prices; local prices and taxes may differ). The yearly plan includes a 7-day free trial for eligible new subscribers.
- Google Play processes all payments. Your subscription renews automatically until you cancel it in Google Play › Payments & subscriptions › Subscriptions. If you cancel during the free trial, you will not be charged.
- Refunds are handled under Google Play's refund policies. You can request a refund from Google Play. We may consider other requests at our discretion; contact hello@thummerapp.com.
- We may change prices for future billing periods; Google Play will notify you as required before a price change applies to you.
5. License and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use Thummer on devices you own or control, for your personal use, under these Terms and Google Play's terms. You agree not to: copy, modify, reverse engineer, or redistribute Thummer except as the law allows; use Thummer on a device you do not own or are not authorized to control; use Thummer to harm, harass, or monitor anyone; or interfere with Thummer's operation or security.
6. Privacy
Thummer has no account and no backend server and does not collect personal data. Google Play handles the subscription. See our Privacy Policy at thummerapp.com/privacy for details.
7. Intellectual property
Thummer, its name, logo, design, and software are owned by Michael Harlow. Thummer is patent pending. These Terms do not give you any rights to our trademarks or other intellectual property beyond the license in section 5.
8. Disclaimer of warranties
THUMMER IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THUMMER WILL PREVENT THEFT, LOSS, OR UNAUTHORIZED ACCESS, OR THAT IT WILL OPERATE WITHOUT INTERRUPTION OR ERROR.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, DEVICES, FUNDS, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THUMMER, INCLUDING ANY THEFT OF YOUR PHONE OR MISUSE OF YOUR ACCOUNTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THUMMER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THUMMER IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Changes and termination
We may update Thummer and these Terms. If we make material changes, we will update the date above and, where appropriate, notify you in the app or on our website. Continuing to use Thummer after changes take effect means you accept them. You may stop using Thummer at any time by canceling your subscription and uninstalling the app. We may suspend or end your license if you violate these Terms.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California, unless the law where you live requires otherwise. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
